Da in Deutschland das Prinzip der Sozialstaatlichkeit gilt, ist die Absicherung im Krankheitsfall gesetzlich verankert: Die Rechtsgrundlage für die gesetzliche Krankversicherung (GKV) ist im Fünften Buch Sozialgesetzbuch (§ 1 SGB V) geregelt. Aufgabe der gesetzlichen Krankenversicherung ist es, "die Gesundheit der Versicherten zu erhalten, wiederherzustellen oder ihren Gesundheitszustand zu bessern (...) . Die Versicherten sind für ihre Gesundheit mitverantwortlich; sie sollen durch eine gesundheitsbewusste Lebensführung, durch frühzeitige Beteiligung an gesundheitlichen Vorsorgemaßnahmen sowie durch aktive Mitwirkung an Krankenbehandlungen und Rehabilitation dazu beitragen, den Eintritt von Krankheit und Behinderung zu vermeiden oder ihre Folgen zu überwinden. Die Krankenkassen haben den Versicherten dabei durch Aufklärung, Beratung und Leistungen zu helfen und auf gesunde Lebensverhältnisse hinzuwirken". Ziele umfassen also sowohl Prävention als auch Gesundheitsförderung. Kennzeichen der GKV ist das Solidaritätsprinzip: Die Beitragssätze richten sich nach der individuellen finanziellen Leistungsfähigkeit der Versicherten. Alleiniges Kriterium für die Inanspruchnahme der Leistungen ist dagegen die Bedürftigkeit (GKV Spitzenverband 2015). Die Starken übernehmen die Lasten der Schwachen. Folglich sollte es keine sozialen Barrieren im Gesundheitssystem geben, eine gleiche Versorgung für alle Bürger unabhängig von der sozialen Schicht müsste gewährleistet sein.
