English summary: On a European level, the principle of good faith has received much attention lately. Despite its roots in Roman Law it is generally regarded as an achievement of German jurisprudence which had a major impact on the development of other jurisdictions. In this work, the author shows that this also applies to the Spanish law of contract, where Treu und Glauben as laid down in 242 of the German civil code was eagerly received by 20th century Spanish legal scholars to complement the Spanish code of 1889. This confirms the approach taken by European legal science, which implements good faith as one of the foundations of European contract law. German description: Im ersten Teil des Buches befasst sich Christian Eckl mit der Entwicklungsgeschichte des Konzepts der 'buena fe in Spanien und zeichnet den Werdegang des spanischen Pendants zu 'Treu und Glauben' von einem allgemeinen Rechtsgrundsatz zur kodifizierten Generalklausel nach. Die untersuchte Zeitspanne reicht von den Vorarbeiten zum Codigo Civil von 1889 bis in die Zeit nach der Reform im Jahr 1974, als der Gesetzgeber beschloss, den Einleitungstitel des Zivilgesetzbuchs um einen neuen Art. 7 zu erweitern. Hiernach muss jedes Recht gemass den Erfordernissen von Treu und Glauben ausgeubt werden. Im zweiten Teil des Buches setzt sich Christian Eckl mit der Konturierung der 'buena fe contractual' durch das spanische Schrifttum und die Rechtsprechung auseinander. Fur den Bereich des Vertragsrechts zeigt er die wesentlichen Lehrmeinungen und grundlegenden Entscheidungen des Obersten Gerichtshofs auf und kommt zu dem Ergebnis, dass Treu und Glauben heute als ein tragendes Prinzip des spanischen Vertragsrechts anzusehen ist. Dieser Befund bestatigt von europaischen Rechtswissenschaftlern erarbeitete Gesetzentwurfe oder Restatements, die eine Harmonisierung des Vertragsrechts in Europa zum Gegenstand haben und in wesentlichen Bereichen auf dem Grundsatz von Treu und Glauben aufbauen.
