English summary: Although contracts for freelance services and contracts of employment are two of the most important types of contract in legal practice, the abstract substance of the duty of the party obliged to perform the services is seldom questioned. Kerstin Tillmanns characterizes both types of contracts for services as contracts of controlled performance. In doing so, she differentiates between these contracts and contracts for work and services, in which the party undertakes to bring about a particular result, and shows the boundary of the admissibility of success-related remuneration components in the contract for services. She rejects attempts to adapt the substance of the duty to the criterion of average kind and quality (Section 243 Paragraph 1 of the German Civil Code), and maintains that the substance of the duty is to be determined according to the objective, individual performance of the party obliged to perform the services. If these services are not suited to the functions to be performed, this has to have an effect on the obligation of the other party. German description: Obwohl freie Dienstvertrage und Arbeitsvertrage zu den in der Praxis wichtigsten Vertragstypen gehoren, wurde die Frage nach dem abstrakten Inhalt der Schuld des Dienstverpflichteten selten gestellt. Kerstin Tillmanns charakterisiert beide Dienstvertragstypen als Vertrage gesteuerter Leistungserbringung, grenzt sie hierdurch von den Werkvertragen ab und zeigt auf, in welchem Masse erfolgsbezogene Vergutungsbestandteile im Dienstvertrag zulassig sind. Bestrebungen, den Schuldinhalt am Massstab mittlerer Art und Gute ( 243 Abs. 1 BGB) zu orientieren, erteilt sie eine Absage; der Schuldinhalt bestimme sich anhand der objektiv-individuellen Leistungsfahigkeit des Dienstverpflichteten. Bei der Bewertung der Leistungsstorungen fordert sie insbesondere, die Minderung der Vergutung nicht auf die Falle der zeitlichen Unterschreitung des Leistungssolls zu beschranken. Der dienstvertragliche Schuldinhalt sei einer funktionalen Betrachtung zu unterziehen. Wenn die Dienste nicht geeignet sind, geschuldete Funktionen zu erfullen, musse dies auf das dienstvertragliche Synallagma durchschlagen. Das gelte im Prinzip auch fur den Arbeitsvertrag, doch sei die Vergutungsminderung hier beschrankt, da der Arbeitnehmer bereits eine Teilleistung erbringe, indem er dem Arbeitgeber seine Arbeitskraft zur Verfugung stelle.
