Thomas Hobbes und John Locke sind Namen, denen man unweigerlich begegnet, sollte man sich mit dem Kontraktualismus auseinandersetzen. Diese zählen zu den Begründern der modernen Vertragstheorie, da beide dem neuzeitlichen philosophischen Denken ein unbestreitbares Fundament gelegt haben. Mit dem Naturzustand bedienen sich beide eines Instrumentes, das den Zweck hat, den Menschen vor der Etablierung einer staatlichen Ordnung darzustellen. In diesem Zustand wird der Mensch beschrieben, wie er in seinem natürlichen Wesen wirkt, und durch welche Mechanismen die Konstruktion eines Staates legitimiert werden kann. Somit sind beide Philosophen durch die Ambition, auf vertraglicher Basis die Legitimation politischer Herrschaft zu begründen, verbunden. Trotz dieser Verbundenheit und vermeintlichen Ähnlichkeit, divergieren beide Philosophen drastisch sowohl in der Darstellung des natürlichen Wesens des Menschen, als auch in dem Begriff der Rechte, die diese im Naturzustand besitzen. Um einen Vergleich dieser beiden Konzepte nachvollziehbar und sinnvoll darzustellen, möchte ich mich in der vorliegenden Arbeit auf diese Elemente konzentrieren. Hierfür soll zuerst eine Darstellung der Elemente der jeweiligen Philosophen stattfinden, nach welcher ich einen fundierten Vergleich aufzustellen. Das Ziel hierbei ist, die Motive und die gedanklichen Ursprünge der Eigenheiten der jeweiligen Naturzustandsauffassungen herauszuarbeiten, um die Unterschiede zwischen dem Hobbesschen und Lockeschen Naturzustand deutlich aufzeigen zu können. Als Grundlage hierfür dient das Hauptwerk "Leviathan" von Thomas Hobbes und das Werk "Zweite Abhandlung über die Regierung" von John Locke. Zum Schluss möchte ic
