Digitale Plattformen konnten durch den Einsatz von Algorithmen neue Geschäftsmodelle entwickeln, die es ihnen ermöglicht haben, in die meisten Wirtschaftssektoren einzudringen: Transport (Uber, BlaBlaCar), kurzfristige Immobilienvermietung (AirBnB, Séjourning), Online-Verkauf (Amazon, Ebay) etc. Diese Plattformen verhalten sich jedoch nicht immer fair (Missbrauch einer marktbeherrschenden Stellung und unlauterer Wettbewerb untereinander, Informationsasymmetrie in ihren Beziehungen zu ihren Nutzern usw.). Aufgrund dieser Feststellung hat der französische Gesetzgeber zum Schutz der Bürger, die die genannten Plattformen nutzen, mit dem Gesetz Nr. 2016-1321 vom 7. Oktober 2016 für eine digitale Republik den digitalen Plattformen einen Grundsatz der Loyalität auferlegt. Worum geht es bei diesem Grundsatz? Welche Bedeutung hat er?
