Malta ist mit 300m² der kleinste Staat in der Europäischen Union und hat ca. 430.000 Einwohnern. Der Großteil der Bevölkerung wohnt in und um die Hauptstadt Valletta. Der Inselstaat liegt inmitten des Mittelmeeres und besteht aus drei bewohnten Inseln: die Hauptinsel Malta, Gozo und Comino. Im ersten Schritt wird die Situation des Eigentumserwerbs durch EU-Ausländer, die rechtliche Zulässigkeit der Vermieter und das Kaufprocedere behandelt. Der darauffolgende Abschnitt schildert die Wohnungssituation in Malta, indem sowohl steuerliche als auch finanzielle Aspekte beleuchtet wurden. Dies wird in einen Kontext, mit der Möglichkeit für deutsche Staatsbürger eine Wohnung zu erwerben, gesetzt. Das Land Malta zählt mittlerweile zu den vollständigen Mitgliedern der Europäischen Union. Während der Heranführungsverhandlungen erzielte Malta, eine erfolgreiche Einigung mit der Europäischen Union bezüglich des Erwerbs von unbeweglichem Vermögen. Im eigentlichen EU-Recht ist es EU-Bürgern gestattet in einem EU-Land ohne Einschränkungen Eigentum zu erwerben. Aufgrund der begrenzten Anzahl von Residenzen in Malta und der begrenzten Baufläche, die nur für die Grundbedürfnisse der gegenwärtigen Einwohner ausreichen, stimmte die Europäische Union einer Sonderregelung zu. Dies wiederspricht dem eigentlichen EU-Recht, aber mit diesem Einverständnis wurde es ermöglicht die diskriminierungsrechtliche Beschränkung von EU-Bürgern aufrechtzuerhalten, die seit mindestens fünf Jahren nicht rechtmäßig in Malta gewohnt haben, um Zweitwohnsitze zu erwerben und zu halten.
