Der Verkehrssektor gehort neben dem Binnenmarkt und der Umweltpolitik zu den Bereichen mit der umfangreichsten europaischen Normsetzung. Entsprechend zahlreich sind die Urteile des Europaischen Gerichtshofs zur Auslegung der dieses Gebiet bestimmenden Regelungen. Das Handbuch analysiert auf dem Stand 2015 die Entfaltung des Verkehrsrechts der Europaischen Union und enthalt eine systematische Darstellung und kritische Bewertung der fur die einzelnen Verkehrstrager geltenden Bestimmungen. Besonderer Wert wurde auf eine detaillierte Auswertung der aktuellen Gesetzgebung und Rechtsprechung gelegt. Der praxisorientierte Schwerpunkt liegt insbesondere auf den Themen:

  • geltende Regeln zur Liberalisierung der Transportdienstleistung einschliesslich des auf die Verkehrswirtschaft bezogenen Wettbewerbsrechts (u.a. VO 1071 - 1073/2009 und 1370/2007 uber den Guter - und Personenkraftverkehr sowie die RL 2012/34 uber den Europaischen Eisenbahnraum)
  • Sicherheit (u.a. VO 549/2004 uber den einheitlichen europaischen Luftraum)
  • Umweltschutz (z.B. RL 2008/08 uber die Beforderung gefahrlicher Guter auf Strassen, Binnengewassern und Eisenbahnen)
  • Schutz der Interessen der Verkehrsnutzer (z.B. VO 261/2004 uber die Rechte von Flugpassagieren)
  • sozial- und arbeitsrechtliche Aspekte (z.B. VO 561/2006 uber Lenk - und Ruhezeiten im gewerblichen Strassenverkehr)
  • bi- und multilateralen internationalen Vertrage (z.B. die Regelungen der Mannheimer Akte fur die Binnenschifffahrt und die Luftverkehrsabkommen der EU) Ein detailliertes Urteilsregister erleichtert den Zugang zur Materie. Die Autoren sind ausgeweisene Kenner: Dr. Roland Bieber ist em. Professor und ehemaliger Direktor des Zentrums fur Rechtsvergleichung, Europarecht und Volkerrecht der Universitat Lausanne. Dr. Francesco Maiani ist Professor am Hochschulinstitut fur offentliche Verwaltung der Universitat Lausanne. Zu den zahlreichen europarechtlichen Schriften beider Autoren gehoren u.a. ein gemeinsam geschriebenes Lehrbuch des Europarechts (Precis de droit europeen, 2. Aufl. Bern 2011). Roland Bieber ist in dem von ihm mitverfassten Standardwerk Die Europaische Union - Rechtsordnung und Politik, (11. Aufl. Baden - Baden 2014) unter anderem fur den Abschnitt Verkehr verantwortlich.
