English summary: According to German mortgage and land charge law, the owner of encumbered land may be entitled to an objection (exceptio) against the assertion of the encumbrance. The German Civil Code (BGB) explicitly regulates the legal consequences regarding such an objection if the encumbrancer assigns the encumbrance to a third party: As a rule, the owner does not lose any objection he had against the previous encumbrancer, unless the purchaser of the encumbrance acquired the encumbrance in good faith. However, the Civil Code does not include any rule regulating the legal fate of such an objection if it is not the encumbrancer assigning his encumbrance but the owner assigning his ownership to a third party. It is the aim of this book to find a solution to this problem by taking into consideration the motives of the legislators of the Civil Code at the end of the 19th century, the differing opinions on this problem in modern German jurisprudence, and the relevant case-law. German text. German description: Beim Wechsel des Grundpfandglaubigers regelt das BGB das rechtliche Schicksal von Einreden des Grundstuckseigentumers in zahlreichen Vorschriften. Im Gegensatz dazu fehlt eine gesetzliche Regelung fur den Fall, dass nicht der Grundpfand-glaubiger das Grundpfandrecht, sondern der einredeberechtigte Eigentumer sein Eigentum ubertragt. Obwohl diese Problematik bereits in unterschiedlichen Zusammenhangen Gegenstand hochstrichterlicher Entscheidungen war, liegt bislang keine umfassende Untersuchung der hiermit verbundenen Fragen vor. Der Autor widmet sich zunachst der Rechtsfigur der Einrede und beschreibt die unterschiedlichen Einreden, welche einem Grundstuckseigentumer gegen die Inanspruchnahme aus einem Grundpfandrecht zustehen konnen, bevor dann unter Auswertung der Gesetzesmaterialien und in Auseinander-setzung mit den hierzu in der Rechtswissenschaft vertretenen Ansichten das rechtliche Schicksal von Einreden des Grund-stuckseigentumers bei einer Ubertragung des Eigentums beleuchtet wird. Die Untersuchung erstreckt sich hierbei unter anderem auf die Fragen, ob (und wie) Einreden uberhaupt ubertragbar sind und ob Einreden automatisch mit dem Eigentum auf einen Erwerber ubergehen konnen.
