English summary: In the present-day theory of constitutional and administrative law, the concept of the relationship between law, administration and the individual continues to be seen from a lawmaking standpoint. One of its dogmas is that the administration should regard a parliamentary law as applicable even if in doing so it has to bring about or accept a situation which is contrary to the constitution. In this work, Hans-Detlef Horn gives the reader a new analysis of this problem, surveying it on the basis of constitutional law as seen from the dogmatical and the theoretical angle and coordinates the dependence of administrative action on the law and the obligation of each administration to act in immediate accordance with individual fundamental rights. German description: Die Entwicklungsgeschichte des modernen Verfassungsstaates kreist um das Verhaltnis von staatlicher Herrschaftsorganisation und individueller Statusordnung. Die rechtsstaatliche Verfassung, die gegen die monarchische Staatsgewalt im 19. Jahrhundert errungen wurde, hatte der Weimarer Staatsrechtslehrer Gerhard Anschutz eine bestimmte Ordnung des Verhaltnisses zwischen Gesetz, Verwaltung und Individuum genannt. Sie bewirkte den Schutz von Freiheit und Eigentum der Burger durch die Bindung der Exekutivgewalt an das allgemeine Gesetz.Hans-Detlef Horn zeigt, wie sich diese Ordnung im demokratischen Grundrechtsstaat des Grundgesetzes verandert hat. Er wendet sich gegen eine in der Staats- und Verwaltungsrechtswissenschaft andauernde antiexekutive Deutungsweise. Hierzu untersucht er den Begriff und den Wandel der beiden ordnungspragenden Faktoren: das in der Verfassung ankernde Gebot der unmittelbaren Grundrechtsmassigkeit jeder Staatsgewalt und das Gebot der Gesetzmassigkeit der Verwaltung. Dabei wird deutlich, dass in den Fallen des Grundrechtsschutzes die (Zu-)Ordnung von Gesetzgeber und Verwaltung neu erfasst werden muss. Als Anschauungsfall dient Hans-Detlef Horn das Dilemma der doppelt gebundenen Verwaltung, entweder legal zu handeln und kollidierende Grundrechte zu verletzen oder grundrechtlich legitim zu handeln, aber unter Missachtung der Legalitat. Daraus ergibt sich, dass die grundgesetzliche Verteilung von gesetzgeberischer und exekutiver Entscheidungskompetenz den Schutz der Grundrechte nicht nur bezweckt, sondern auch gebietet. Vor diesem Hintergrund entwirft Hans-Detlef Horn die Grundzuge einer Lehre von der staatlichen Gewaltengliederung als eines Prinzips, das die demokratische und die grundrechtliche Legitimation staatlichen Handelns organisiert.
