English summary: At first sight, the exemption clauses in international private law seem somewhat peculiar. However, today they are a significant part of the most recent acts in the field of conflict of laws. They are the well-known means of recovering the so-called classical approach of Savigny from the criticism of the modern American approaches of Currie, Cavers and others which were fashionable in Europe after World War Two. In this work, Thomas Hirse studies the exemption clauses and the questions they raise in the general theory of the conflict of laws. Against the backdrop of the problems caused by the concretion of these general clauses, he does a detailed analysis of the status of general methodology in the conflict of laws. The author is critical of the fact that the main approach to concretise the exemption clauses discussed in literature using groups of comparable cases does not meet the requirements of their function and is not the normative method. Instead he prefers to concretise the exemption clauses by analysing and weighing the private interests of the persons involved in the individual case concerned. German description: Thomas Hirse untersucht die Ausweichklauseln und die durch sie aufgeworfenen Fragen in der allgemeinen Kollisionsrechtslehre. Er setzt sich im Rahmen der Problematik der Konkretisierung dieser kollisionsrechtlichen Generalklauseln umfassend mit dem Stand der allgemeinen Methodenlehre im Kollisionsrecht auseinander. Als Ausweichklauseln sind solche gesetzlich fixierten Kollisionsnormen anzusehen, die im Einzelfall ausnahmsweise die Anwendung einer anderen als anhand einer ebenfalls gesetzlich fixierten Regelverweisung ermittelten Rechtsordnung zulassen, namlich der, mit welcher der konkrete Sachverhalt eine wesentlich engere Verbindung im Sinne des Savignyschen Anknupfungsprinzips besitzt. Trotz der im IPR generell erhohten Anforderungen an die Vorhersehbarkeit des anwendbaren Rechts sind die Ausweichklauseln als Notventil zugunsten der Anknupfungsgerechtigkeit im Einzelfall erforderlich. Die methoden- und funktionsgerechte Konkretisierung der Ausweichklausel kann nur anhand einer umfassenden Bewertung der konkreten privaten Rechtsanwendungsinteressen der beteiligten Privatpersonen in jedem Einzelfall vorgenommen werden. Das rechtsethische Prinzip der engsten Verbindung trifft hierfur lediglich eine Vorwertung dahingehend, dass sie unabhangig vom Inhalt und der rechtspolitischen Qualitat der potentiell anwendbaren Sachrechte, losgelost also von materiellrechtlichen Ergebnisvorstellung erfolgen muss. Diese Konkretisierungsmethode setzt voraus, dass entsprechend der allgemeinen Methodenlehre auch im Kollisionsrecht konsequent von der Interessenjurisprudenz zur Wertungsjurisprudenz ubergegangen wird. Dagegen ist die vorherrschend zur Konkretisierung vertretene Fallgruppenmethode weder eine normative Methode noch kann sie der rechtspolitischen Funktion der Ausweichklausel gerecht werden.
