The volume is a collection of several contributions from a major conference in Florence in 2010. It attempts to make a contribution to the field by examining the controversy between the opinions of jurists from different perspectives, both chronological and thematic: from the changes that have occurred after the end of the res publica and the appearance of an imperial power who immediately sought a dialogue with legal science, in order to manage the growing mass of discontent, to the implications we can grasp from the processual praxis, particularly in the discipline of fluid and mutable fields (such as negotiations entrusted to slaves and filii familias), as well as other cultivated literary genres and in the representations of the phenomenon provided by the same lawyers, or yet still, in an effective application known within the provincial reality. Italian description: La consapevolezza del ruolo centrale assunto dai giuristi nell' esperienza giuridica romana - in particolare riguardo alla disciplina delle relazioni fra privati - ha condotto, soprattutto negli ultimi decenni, a concentrare sempre piu l' attenzione sui relativi stili di lavoro (con le tecniche di analisi casistica e di argomentazione che ne furono progressivamente affinate), sui rapporti fra la loro interpretatio e le previsioni legislative e (ancor piu) magistratuali, sulle dinamiche attraverso le quali si svilupparono e si confrontarono per secoli le soluzioni che essi elaborarono affrontando un' innumerevole serie di casi: soluzioni tutte produttive di ius ma inevitabilmente non sempre dello stesso tenore. Declinato il mito del classico', che tanto aveva inciso sull' idea moderna di una fungibilita degli antichi prudentes (cosi come sulle raffigurazioni di un unico e metastorico regime di molti istituti, rispetto al quale ogni voce dissenziente doveva essere posta a tacere tramite ipotesi di interpolazione), e in questa prospettiva che e ancora in gran parte da scrivere una storia del diritto, anche privato, fra tarda repubblica ed eta dei Severi.Il libro curato da Valerio Marotta ed Emanuele Stolfi intende, raccogliendo i contributi di un importante convegno fiorentino del 2010, offrire un contributo in questa direzione, esaminando la controversialita fra le opinioni dei giuristi da diverse prospettive, sia cronologiche che tematiche: dai mutamenti intervenuti con la fine della res publica e l' apparizione di un potere imperiale che da subito ricerco un dialogo con la scienza giuridica, anche al fine di gestirne la massa crescente di dissensiones, alle implicazioni che possiamo cogliere nella prassi processuale (e in un' altra ars che vi era coinvolta, quale la retorica), nella disciplina di settori particolarmente fluidi e mutevoli (ad esempio quello delle negotiationes affidate a schiavi e filii familias), come pure nei generi letterari coltivati e nelle rappresentazioni del fenomeno fornite dagli stessi giuristi, o ancora nell' effettiva applicazione conosciuta entro le realta provinciali. Ne e emerso un quadro variegato e composito, in grado di intercettare alcuni dei piu significativi fenomeni che interessarono la vita del diritto nei secoli centrali della storia di Roma, cosi da tracciare le linee di fondo per ulteriori indagini che possano far luce su molteplici aspetti di una delle eredita piu incisive che l' antichita abbia trasmesso alla cultura dell' Occidente.
